Understanding how child support is calculated


When a child support order comes from the courts, the non-custodial parent who owes child support has a legal duty to pay. Failure to do so could lead to serious consequences, including but not limited to changes in one's credit rating, wage garnishment and even contempt of court, which could lead to time in jail.

For residents of the Atlanta, Georgia, area and throughout the state, if you are struggling to have your ex-spouse keep up with child support payments the Georgia Department of Human Resources, Division of Child Support Services department, or DCSS, may be able to help. You could speak with a case manager to help you collect the payments.

There are several ways that the DCSS can try to collect child support payments, such as taking from the non-custodial parent's paycheck or unemployment check, federal or state income tax refunds or take from a workers' compensation benefits. There are other ways they could punish or encourage them to step up as well, including the suspension of a person's driver's license or occupational license, and even liens and levies on property. Sometimes, it is in the parties' best interests to try to work together to come up with a reasonable outcome. Even a partial payment is sometimes better than no payment. Sometimes punishing a parent will only further sever the ties and make things even harder moving forward.
